Baliwag Water District (BWD) upholds the right to privacy of its Data Subjects. This Privacy Policy governs the collection, processing, storage and disclosure of Personal Information of the Data Subjects when transacting with BWD to comply with the requirements of the Data Privacy Act of 2012.
- Collection of Personal Data
BWD collects Personal Information from the Data Subjects. Such personal information may be provided to BWD in filled out forms, letters, email messages, SMS, contracts, legal documents, telephone conversations, face to face meetings, Facebook, or through the official BWD website.
BWD collects the following Personal Information from the following categories of Data Subjects:
- New Connection Application
BWD stores, processes, and analyzes the information that a Data Subject provides for the following purposes:

Information in filled up application form(s) for new connection application, such as name, address, telephone number, birthday, and such other information proving legal tenure over the premises served by the water or sanitation service.
BWD will not collect Sensitive Information unless required by applicable law(s). .

Information provided to avail of the senior citizen’s discount;
- Existing concessionaires
BWD stores, processes, and analyzes the information that a Data Subject provides for the following purposes:

Information in filled up application form(s) for water, sewerage or sanitation services, such as name, address, telephone number, birthday, and such other information proving legal tenure over the premises served by the water or sanitation service.
BWD will not collect Sensitive Information unless required by applicable law(s).

Billing and payment information used to pay for water and environmental charges. However, payments made via bayad centers and SM payment center by such payment service and are governed by the applicable payment service’s privacy policy.

Information provided to avail of the senior citizen’s discount;

Information provided in customer surveys;

Information communicated with BWD through letters, email, SMS, Customer Care Staff, Relationship Managers, relating to meter or billing complaints, reporting of leaks, desludging queries, water quality, pressure, and availability concerns, and such other information that is voluntarily provided at the point of collection of such information.
- Active and separated employees

Information contained in curriculum vitae;

Information gathered from selection interviews, written skills tests, assessment results, character references, and such other information that BWD may collect necessary for recruitment decisions or to assess the suitability of applicants for positions in BWD;

Information collected during the course of employment such as work history, payroll information, information pertaining to statutory remittances including, but not limited to, GSIS, PhilHealth, Pag-Ibig, taxes, health benefits, beneficiaries, emergency contact information, trainings, performance evaluations, and such other information contained in an employee’s 201file;

Any other information provided at the point of collection of such information.
- Suppliers, vendors and consultants

Information submitted for purposes of accreditation or vetting of credentials;

Any other information provided at the point of collection of such information.
- Guests and visitors

Information provided such as name, address, agency, telephone number, vehicle’s plate no;

- General public

Informartion gathered through CCTV recordings.
- Use of Personal Data
BWD stores, processes, and analyzes the information that a Data Subject provides for the following purposes:
- New Connection Application

To determine eligibility and validly process the application and to secure the legality of the new connection application;

To determine eligibility for senior citizen’s discount.
- Existing concessionaires

To provide BWD’s services;

To determine eligibility for senior citizen’s discount;

To meet the purpose(s) for which a Data Subject has submitted the information, and any information relating thereto such as, but not limited to, water service interruptions, updates and alerts;

To respond to a Data Subject’s inquiry, concern or complaint;

To enable BWD to accept bill payments according to a Data Subject’s enrolled payment mode;

All other purposes in connection with BWD’s provision of water and sanitation services.
- Active and separated employees

For recruitment purposes;

For administering pay, statutory deductions, entitlements and benefits;

For maintaining employment records and complying with applicable statutory and regulatory submissions;

For processing employee work-related claims;

For HR-related concerns including, but not limited to, administering disciplinary actions, conducting performance reviews, establishing appropriate training and developmental interventions;

All other purposes concerning employment concerns.
- Suppliers, vendors and consultants

For supplier or vendor accreditation;

For vetting of credentials;

For establishing business relationships and facilitating the payment of invoices for goods delivered or services rendered;

For maintaining or updating vendor/supplier account information;

For complying with legal and regulatory requirements.

All other purposes concerning employment concerns.
- Guests and visitors

For establishing identity and recording the purpose of the visit;

For monitoring visitor’s activities within the Company premises.
- Limitation of Access
Personal Information may only be shared, (i) when BWD has the Data Subject’s consent (express or implied, provided that the use or processing of Personal Information is compatible with the purpose for which the same was collected), (ii) on a need-to-know basis, with individuals employed by BWD who have a legitimate business or supervisory interest in the Personal Information, and (iii) where it is necessary to meet the purpose(s) for which such Data Subject has provided the Personal Information.
In cases where BWD engages the services of a third party contractor to assist with its activities, such third party is contractually bound to keep the Personal Information confidential.
- Disclosure of Personal Data to Third Parties
Personal Data shall not be disclosed to third parties except under the following circumstances:

When required by law or by the DPA;

Upon reasonable request of government regulators;

When there is written consent obtained from the Data Subject;

Where BWD has engaged a third party such as data intermediaries or subcontractors specifically to assist with its activities. Any such engagement shall be covered by Non-Disclosure or Confidentiality Agreements.
- Accuracy of Personal Data
BWD undertakes to make reasonable efforts to ensure that the Personal Data that it collected or was collected on its behalf is accurate and complete.
- Access to and Correction of Personal Data
Upon a Data Subject’s request, BWD undertakes (i) to provide the Data Subject with access to his Personal Information; (ii) to correct an error or omission in a Data Subject’s Personal Information that is in BWD’s possession or control.

- Security and Protection of Personal Data
BWD undertakes to implement reasonable and appropriate organizational, physical and security measures to protect Personal Information against any accidental or unlawful destruction, alteration, breach and disclosure, as well as against any other unlawful processing.

Personal Information of Data Subjects
– Personal information of concessionaires shall be handled with strict confidentiality. No person or entity shall be allowed to access said personal information without the consent of the data subject or a valid court order.

Personal Information of Employees
– No personal information of any employee shall be accessed or shared with any other person or entity without the consent of said employee or a valid court order, Provided, that in cases of employee verification, only the necessary information such as but not limited to, years in service, designation, salary grade level, employment history, shall be disclosed in accordance with the law.

Use of scratch paper
– No scratch papers containing personal information of any person shall be re-used. All papers containing personal information shall be kept in accordance with the retention period set and shall be immediately disposed in accordance with the disposal procedure provided by the National Archives of the Philippines.

Electronic copies of Personal Information
– Electronic copies of documents containing personal information of data subjects shall be handled with utmost confidentiality. No person or entity shall be allowed to access said personal information without the consent of the data subject or a valid court order. The BWD shall establish physical and database security to protect such documents.

Policy on usage of information technology
– BWD shall protect the information technology in compliance with the office policy on the usage, prohibitions, retention, and disposal. Furthermore, BWD shall provide sufficient physical and technological measures that shall protect said information technology.

Policy on reproduction
– BWD shall regulate the production and reproduction of documents containing personal information of data subject pursuant to existing policies and laws.

Policy on data sharing
– No personal information of any data subject shall be accessed or shared with other person or entity without the consent of said data subject or a valid court order, Provided, that in cases of contracting/subcontracting of third party services, sharing of personal information shall be allowed, Provided further, that data sharing agreement shall be established in accordance with the DPA in order to protect the personal information of the data subject.

Security on Infrastructure
– BWD shall ensure security of its infrastructures by providing physical and technological measures in accordance with the existing laws and policies.

Disposal
– BWD shall dispose documents containing the personal information of data subject after the prescriptive period of retention and shall be disposed in accordance with the rules on disposition as approved by the National Archives of the Philippines.
- Retention of Personal Data
BWD will keep Personal Information for as long as necessary:

to fulfill the declared, specific and legitimate purposes for which the Personal Information is received; or
-
for the exercise of legal or business purposes that are consistent with the standards established or approved by the relevant government authorities.
Thereafter, BWD will cease to retain the Personal Information, which shall then be disposed of or discarded in a secure manner that would prevent its further processing or unauthorized use or disclosure in accordance with the disposal procedure provided for by the National Archives of the Philippines.
- Modifications
BWD reserves the right to modify, amend, or supplement this Policy at any time.
